Acceptance of Terms
By accessing marcomdaddy.com, contacting us about our services, or entering into a service agreement with Marcom Daddy, you confirm that you have read, understood, and agree to be bound by these Terms of Service.
If you are entering into these terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms.

Our Services
Marcom Daddy is an AI-powered creative and digital marketing agency based in India, offering services including but not limited to:
- Brand strategy, positioning, and identity development
- Web design and app design (UI/UX)
- Content marketing — SEO content, copywriting, brand storytelling
- Digital marketing — SEO, social media management, performance marketing, PPC
- Graphic and visual design services
- Video production and podcast services
The specific scope, deliverables, timelines, and fees for any engagement are defined in a separate written agreement, proposal, or statement of work shared with you prior to commencement of work.
We reserve the right to modify, suspend, or discontinue any service at any time, with reasonable notice where a client engagement is ongoing.
Client Engagements
Project commencement
Work begins only after a written agreement or proposal has been accepted and any required advance payment has been received. Verbal agreements do not constitute a binding commitment from Marcom Daddy.
Client responsibilities
You agree to provide accurate, complete, and timely information, materials, and approvals required for us to deliver our services. Delays caused by late provision of required content, feedback, or approvals may affect timelines and are not the responsibility of Marcom Daddy.
Revisions and scope changes
Each engagement includes a defined number of revision rounds as specified in the project proposal. Requests for work outside the agreed scope — including additional features, pages, deliverables, or significant change of direction — will be quoted separately as change requests before proceeding.
Approval and sign-off
Final deliverables are considered accepted and approved when you provide written sign-off, or when 7 business days have passed since delivery without written objection. Post-approval revisions are billable at our standard rates.
Third-party services
Where our work requires third-party tools, platforms, subscriptions, or stock assets (e.g. domain registration, hosting, stock photography, software licences), these costs are your responsibility unless explicitly included in your agreed proposal.
Payment & Fees
Fees and invoicing
All fees are as stated in your agreed proposal or statement of work. Invoices are issued at the milestones or intervals specified in your agreement. All amounts are in Indian Rupees (INR) unless otherwise stated.
Payment terms
Invoices are due within 14 days of issue unless alternative terms are agreed in writing. For new client projects, a deposit of 50% is typically required before work commences, with the balance due on project completion or as agreed.
Late payments
Late payments may result in a pause of active work until outstanding amounts are settled. We reserve the right to charge interest on overdue invoices at 2% per month after the due date. We also reserve the right to withhold delivery of final files until payment is received in full.
Refunds
Deposits paid to commence work are non-refundable once work has begun, as they cover time and resources already allocated. If you cancel a project mid-way, you are responsible for payment of all work completed up to the point of cancellation. Disputes regarding quality must be raised within 7 days of delivery.
⚠ Payments made via third-party platforms (e.g. Razorpay, PayPal) are subject to those platforms' own terms and processing fees, which are the client's responsibility.
Intellectual Property
Ownership of deliverables
Upon receipt of full payment for a project, Marcom Daddy assigns to you the ownership of the final agreed deliverables specifically created for that project (e.g. logo files, website design, written content). This assignment is limited to the deliverables defined in your project scope.
Our underlying tools and methods
All underlying processes, methodologies, frameworks, code libraries, templates, AI tools, and proprietary systems used to create your deliverables remain the exclusive intellectual property of Marcom Daddy. You receive a licence to use the output — not the underlying tools used to create it.
Third-party assets
Where third-party assets are incorporated into your deliverables (e.g. stock images, icon libraries, fonts), your use of those assets is subject to the licence terms of the respective rights holders. We will inform you of any significant third-party licence requirements.
Portfolio use
You grant Marcom Daddy a non-exclusive, royalty-free licence to display work created for you in our portfolio, case studies, social media, and marketing materials, unless you request confidentiality in writing before project commencement.
Website content
All content on marcomdaddy.com — including text, graphics, logos, and design — is the property of Marcom Daddy and protected by applicable intellectual property law. You may not reproduce, distribute, or use any content from this site without our prior written permission.
Confidentiality
Both parties acknowledge that during an engagement, each may receive confidential information belonging to the other — including but not limited to business plans, customer data, financial information, creative strategies, and technical details.
Both parties agree to:
- Keep all confidential information strictly confidential
- Use confidential information solely for the purposes of the engagement
- Not disclose confidential information to any third party without prior written consent
- Take reasonable precautions to protect the confidentiality of such information
This obligation survives the termination of any engagement for a period of 3 years. It does not apply to information that is already publicly available or that either party is required to disclose by law.
Acceptable Website Use
By using marcomdaddy.com, you agree not to:
- Use the site in any way that violates applicable local, national, or international law
- Transmit unsolicited commercial communications (spam)
- Attempt to gain unauthorised access to any part of our website, servers, or connected systems
- Introduce viruses, malware, or any other malicious or technologically harmful material

Limitation of Liability
To the fullest extent permitted by applicable law, Marcom Daddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services — including loss of profits, data, goodwill, or business opportunities.
Our total aggregate liability to you for any claim arising from a specific project engagement shall not exceed the total fees paid by you for that specific project.
Nothing in these terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or any other liability that cannot be excluded or limited under applicable law.
Termination
Termination by you
You may terminate an ongoing engagement by providing written notice. You remain liable for all fees for work completed up to the date of termination. Any deposits paid are non-refundable.
Termination by us
We may terminate or suspend services immediately, without prior notice or liability, if you:
- Breach these Terms of Service in a material way
- Fail to make payment within the agreed terms after a reminder
- Request work that is illegal, unethical, or contrary to our values
- Engage in abusive, harassing, or threatening conduct towards our team
Effect of termination
Upon termination, all licences granted to you for unpaid deliverables are immediately revoked. Provisions of these terms that by their nature should survive termination — including intellectual property, confidentiality, and limitation of liability — shall continue in force.
Governing Law & Disputes
These Terms of Service are governed by the laws of India. Any disputes arising out of or in connection with these terms shall first be subject to good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days, it shall be subject to the exclusive jurisdiction of the courts of Bengaluru, Karnataka, India.
For clients outside India: nothing in these terms affects your rights under the mandatory consumer protection laws of your own country where those laws cannot be excluded by contract.
Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. When we do, we will update the "Last updated" date at the top of this page.
For active client engagements, material changes to terms will be communicated directly. Continued use of our website after changes are posted constitutes acceptance of the revised terms.
We encourage you to review these terms periodically. The version in effect at the time of your most recent project agreement governs that engagement unless both parties agree otherwise in writing.
